Eric Lucas

Counsel

Eric is a registered patent attorney with a technical background in computer science.

While much of his work does involve complex patent infringement litigation, he has also litigated copyright infringement and trade secret misappropriation claims, as well as matters involving fraud, breach of contract, and various other business torts.

Eric has significant trial experience around the country in various federal and state courts, as well as before the International Trade Commission and the Patent Trial and Appeal Board of the U.S. Patent and Trademark Office.

Eric also advises clients on various intellectual property matters, including issues involving trademark and trade dress, art law, designing around patents, and avoiding copyright infringement of proprietary source code.

Experience

Representative matters

Volkswagen Group of America in winning first-of-its kind writ of mandamus from the Court of Appeals for the Federal Circuit vacating WDTX denial of motion to dismiss or transfer for improper venue. Dealerships in WDTX not proven to be agents of Volkswagen.

Nichia Corporation, as lead counsel, in a 3-patent ITC Investigation in which all asserted claims were found not infringed, not supportive of a technical domestic industry, and/or invalid.

SS&C as plaintiff in trade secret litigation, resulting in $44M jury award, plus fees, against a key competitor.

Pro bono

Advises NYC-based artists, in connection with Volunteer Lawyers for the Arts, on a variety of legal issues.

Advises aspiring NYC-based entrepreneurs, in connection with the Neighborhood Entrepreneur Law Project, on business formation and intellectual property protection.
